Rental Agreement, Assumption of Risk, Liability Waiver & Damage Responsibility

By signing below, I acknowledge that I have read, understood, and voluntarily agree to the following terms.

I certify that I am at least 21 years of age. I possess a valid driver’s license. I am physically and mentally capable of safely operating the rented equipment. I am not under the influence of alcohol, marijuana, illegal drugs, or any medication that impairs my ability to operate the equipment safely.

Assumption of Risk

I understand that operating jet skis, UTVs, trailers, and related equipment is an inherently dangerous activity that may result in property damage, serious injury, permanent disability, or death.

I voluntarily assume all risks associated with the rental and operation of the equipment, whether known or unknown.

Release of Liability

To the fullest extent permitted by California law, I release and hold harmless Shasta Powersports Rentals LLC, its owners, employees, agents, contractors, and representatives from any claims, demands, lawsuits, injuries, losses, damages, or expenses arising out of my rental or operation of the equipment, except where liability cannot legally be waived, such as gross negligence or willful misconduct.

Damage Responsibility

I accept full financial responsibility for any damage or loss occurring during my rental period, including but not limited to:

Collision damage
Rollovers
Hull or body damage
Engine damage
Water ingestion or hydrolock
Tire, wheel, or suspension damage
Trailer damage
Lost keys or safety equipment
Towing and recovery costs
Excessive cleaning
Fuel charges
Any damage caused by unauthorized drivers

I authorize Shasta Powersports Rentals LLC to charge the payment method on file for approved charges permitted under this agreement and applicable law.

Safe Operation Rules

I agree that I will:

Operate the equipment safely and responsibly.
Follow all federal, state, and local laws.
Wear all legally required safety equipment.
Never operate while impaired by alcohol or drugs.
Never allow anyone not listed on the rental agreement to operate the equipment.
Immediately stop using the equipment if a warning light appears or a mechanical issue develops and notify the Company.

Inspection

I acknowledge that I inspected the equipment before my rental and found it to be in good operating condition unless otherwise noted on the inspection form.

Indemnification

I agree to defend, indemnify, and hold harmless Shasta Powersports Rentals LLC from claims, damages, attorney’s fees, and expenses arising from my use of the rented equipment or the actions of anyone using the equipment under my reservation.

Governing Law

This Agreement shall be governed by the laws of the State of California. Any legal action shall be brought in the appropriate court located in Shasta County, California, unless otherwise required by law.

Electronic Signature

I agree that my electronic signature has the same legal effect as a handwritten signature.

Customer Acknowledgment

I have read and understand this Agreement. I understand that operating powersports equipment involves serious risks, including death. I accept financial responsibility for damage occurring during my rental as provided in this Agreement. I will not allow unauthorized operators to use the equipment. I will not operate under the influence of alcohol or drugs. I agree to follow all operating and safety instructions.
